Driver’s license: it is a crime to lie about the driver to avoid loss of points

The Supreme Criminal Court, in ruling no. 19527/2016, ruled that a person who transmits the driver’s data disclosure form to the State Police having reported on it the details of another person, instrumentally indicated in order to avoid the deduction of points on the license, may incur the crimes of substitution of person and false statement to a public official.

Supreme Court: using commonplaces does not mean offending

A recent ruling by the Court of Criminal Cassation (No. 24065/2016) shows that there is no crime of defamation when offensive statements directed at a person simply report “commonplaces.” Indeed, the Courts of legitimacy have made it clear that in order for the crime of defamation to be said to be integrated, it is necessary that from the offensive expressions used it is possible to reliably identify one or more specific and determined individuals.

Supreme Court: lawful not to pay rent if the house is not up to standard

The Supreme Court of Civil Cassation, in ruling no. 8637/2016, ruled that it is lawful to suspend the payment of lease payments if during routine maintenance work, defects not recognizable at the time of entering into the lease agreement are discovered that make the dwelling unsafe and substandard, thus making it impossible to enjoy it.
